Can Someone Else Drive My Car?
Can someone else drive your car? The answer is yes, but be careful. Florida law states that the owner of a vehicle is responsible for the driver’s actions under the Dangerous Instrumentality Doctrine. This doctrine allows accident victims, under certain circumstances, to sue the owner of the vehicle that injured them.
Here are a few things you should keep in mind before you lend someone your keys:
- Do you trust them? Once you give consent to someone to drive your vehicle, you assume a duty to ensure the vehicle is operated safely. You should only allow someone to drive your car who has a license or permit, and who you believe will drive safely and responsibly.
- Do you have good auto coverage? Even if you trust the driver, you will still be held responsible if they cause an auto accident due to their negligence. Your auto insurance should cover any car accidents that involve the vehicle, even if you were letting someone else drive it at the time. Check your auto insurance policy again to make sure you have good bodily injury coverage.
